Supreme Court USA
INTRODUCTION
Brothers and Sisters!
Assalam o Alleyykum!
-
The Supreme Court of the United States is the
highest court in the federal judiciary of the United States.
-
The Court has the power of judicial review, the ability to invalidate a statute for violating a provision of the Constitution or an executive act for being unlawful.
-
According to federal statute, the Court normally consists of the Chief Justice of the United States and eight associate justices who are nominated by the President and confirmed by the Senate. Once appointed, justices have lifetime tenure unless they resign, retire, or are removed from office.
INDEPENDENCE
Brothers and Sisters! Although Chief Justice and Associate Justices are nominated by the President and confirmed by the Senate they are supposed to be independent.
PERSPECTIVE
Brothers and Sisters!
-
As Chief Justice and Associate Justices are nominated by the President therefore the President and the political party he belongs to make every effort that the Chief Justice or Associate Justices to be confirmed by the Senate.
-
Associate Justice Anthony Kenney retired on 18 July 2018. To fill the vacancy President Donald Trump nominated Judge Brett Kavanaugh who previously served as a United States Circuit Judge of the United States Court of Appeals for the District of Columbia Circuit and as a staff lawyer for various offices of the U.S. government.
-
It is precedent that when someone is nominated for a higher post in the public service his whole life: private, public service and otherwise is investigated by the FBI to ascertain if there are any flaws in the Personality and Character of the nominee where he is unfit for the post he is being nominated for. For this purpose all the documents relating to the public service are released to the Senate Judiciary Committee where every member of the Committee critically browses the documents and can ask questions from the nominee about his public service record.
-
But President Donald Trump took advantage of the President’s privilege under the Constitution not to release all the documents. As below the news in respect of the release of the documents is self-explanatory:
Democrats slam White House for withholding documents on Supreme Court nominee
September 2, 2018 / 5:03 PM / a month ago
WASHINGTON (Reuters) – Democrats on Sunday criticized the Trump administration for refusing to release thousands of documents on Brett Kavanaugh ahead of this week’s upcoming Senate hearings on his nomination to the U.S. Supreme Court.
Kavanaugh, nominated by President Donald Trump, worked in the White House under former President George W. Bush, whose lawyers combed through documents from that time and decided that 27,000 of them were protected under “constitutional privilege.”
The White House directed them not to hand them over to the Senate Judiciary Committee, one of Bush’s lawyers said in a letter to the chairman of the Senate Judiciary Committee, which will host the hearings scheduled to start on Tuesday.
Another 102,000 pages of documents related to Kavanaugh’s record were not turned over for other reasons. The committee has had access to more than 415,000 pages on Kavanaugh’s background, the lawyer said in the letter.
Dick Durbin, the No. 2 Senate Democrat, said in an interview aired on “Fox News Sunday” that the White House’s citation of privilege on the documents was the first time that had occurred.
“There has been more concealment of documents that are concerning his public service and his position on issues than ever in the history of the United States … If he’s so proud of his conservative credentials, show us the record,” Durbin said.
Democratic Senator Amy Klobuchar, a Judiciary Committee member, echoed Durbin’s concerns in an interview with NBC’s “Meet the Press” on Sunday, saying, “This is not normal.”
Republicans have dismissed Democrats’ concerns over lack of access to portions of the record on Kavanaugh’s background, arguing their criticism is politically motivated.
“Democrats have more than enough information to understand that this is a highly qualified jurist that should be the next Supreme Court justice,” Wisconsin U.S. Senator Ron Johnson, a Republican, said in an interview on ABC’s “This Week.”
Brothers and Sisters! The private life of the nominee is also investigated by the FBI to ascertain that he has not been involved in the criminal and civil offense. Moreover, if any member of the public is aware of any offense committed by the nominee then he is also under
obligation
also come forward and exposes the incident to the Judiciary Senate Committee.
Brothers and Sisters! In short, Christine Margaret Blasey Ford an American professor of psychology at Palo Alto University and a research psychologist at the Stanford University School of Medicine
accused Judge Brett Kavanaugh that he sexually assaulted her in a house party in the early 80s. As below are the details of accusation copied from the Google Network:
In early July 2018, when Kavanaugh’s name was on a shortlist of nominees for the Supreme Court, Christine Blasey Ford, a psychology professor at Palo Alto University, contacted a Washington Post tipline and her local congress woman Anna Eshoo (D-California) with allegations that Kavanaugh had sexually assaulted her in high school Following a September 12 report in The Intercept, Senator Dianne Feinstein (D-California) confirmed a complaint had been made against Kavanaugh by a woman who had requested not to be identified. Feinstein stated that the woman accused Kavanaugh of trying to force himself on her while physically restraining her when they were both in high school. On the same day, Feinstein stated she had forwarded the allegation to federal authorities.
On September 16, Ford said Kavanaugh had sexually assaulted her when she was 15 and he was 17. Ford stated that in the early 1980s, Kavanaugh and Mark Judge, one of Kavanaugh’s friends from Georgetown Prep School, corralled her in a bedroom at a house party in Maryland and turned up the music that was playing in the room. According to Ford, Kavanaugh pinned her to the bed, groped her, ground against her, tried to pull off her clothes, and covered her mouth with his hand when she tried to scream. Ford said she was afraid Kavanaugh might inadvertently kill her during the attack and believed he was going to rape her. Ford stated that she escaped when Judge jumped on the bed, knocking them all to the floor.
Kavanaugh issued the following statement through the White House: “I categorically and unequivocally deny this allegation. I did not do this back in high school or at any time.” Republicans criticized the decision to withhold “a vague, anonymous accusation for months” before releasing it on the “eve of [Kavanaugh’s] confirmation” as an attempt to delay the Kavanaugh confirmation hearings. Kavanaugh released a statement on the evening before Ford’s and Kavanaugh’s scheduled testimony before the Senate Judicial Committee, that due to the serious nature of the allegations, both he and Ford deserved to be heard. He also stated, “I am innocent of this charge.”
Brothers and Sisters!
Alhamdu’lillah! Project: Call for Peace warranted to let the nomination process view critically.
Brothers and Sisters! In short, Judge Brett Kavanaugh has been confirmed by the Senate Judiciary committee by 50 – 48 Senate votes and now he is among the Associate Justices of the Supreme Court of USA.
Brothers and Sisters! The confirmation of Judge Brett Kavanaugh is controversial. Therefore project: Call for Peace is going to analyze the nomination critically and try to prove that the accusation of Sexual Assault by Judge Brett Kavanaugh is true and under the constitution of USA he should not have been confirmed as an Associate Justice of the Supreme Court of USA.
