Defence

Assalam o Alleyykum!

Sexual urge is such an element that arouses as soon as man and woman not even come across each other but when they mentally think about it. If he cannot find a counterpart and cannot control his Sexual desire then he masturbates.

In short, to satisfy Sexual desire is such an issue that the son, Qabeel, of Hazrat Adam (PBUH) killed his brother Habeel and kidnapped his sister to satisfy his Sexual urge and this was start of ‘Incest’. Incest means to satisfy Sexual urge with woman with who one cannot marry in accordance of the rules of Sharia. For example:
- father and daughter
- brother and sister
- mother and son
- otherwise
In other words in case of incest and otherwise it is the abuse of power which leads to satisfy the Sexual urge.
In the modern age it has become part of life that men and women work side by side. This leads to having consensual affairs and if the Boss cannot seduce his subordinate for consensual affair then he abuses his power to satisfy his Sexual urge.
To satisfy Sexual urge, people go the night clubs, casinos, brothels and otherwise. To satisfy Sexual urge house parties are arranged where men and women drink alcoholic drinks and it is implied concept that everyone can be seduced and have sexual intercourse.
Similarly, in offices and otherwise when Boss is attracted by the looks of his subordinate he tries to seduce her by conversation of sexual nature to arouse her sexual urge.

SUBJECT MATTER

The subject matter is that according to Dr Christine Blasey Ford she was Sexually assaulted by Judge Kavanaugh in early 80s at a house party.
In short, the case has to be heard by the Senate Judiciary Committee at a Special Hearing to determine if the allegations of Sexual assault against Judge Brett Kavanaugh are true. In this case Judge Brett Kavanaugh had to defend himself before the Senate Judiciary Committee.
Judge Brett Kavanaugh had practiced as lawyer and also rendered his services as Circuit Judge of the United States Court of Appeal.
It is natural phenomenon that when one prepares for his defence, first he looks at the ‘precedents’ i.e. who was in this situation and how he defended himself and got away with it.
In short, Judge Brett Kavanaugh may have followed the defence of Judge Clarence Thomas before the Senate Judiciary committee in the year 1991as he had entered in the legal profession in the year 1990:

Kavanaugh was admitted to the Maryland Bar in 1990 and the District of Columbia Bar in 1992
So it can safely be assumed that when Judge Brett Kavanaugh was accused of Sexual Assault by Dr Christine Blasey Ford he must have critically watched the defence by Judge Clarence Thomas before the Senate Judiciary Committee to prepare his defence.

Brothers and sisters! The project: Call for Peace warranted to watch the testimonies of Judge Clarence Thomas and Judge Brett Kavanaugh critically and observed the following ‘Similarities’ in their defence before the Senate Judiciary Committee.

Aggressiveness

Brothers and sisters! It is natural phenomenon that in the court of law the lawyers on behalf of their clients present their representations and arguments aggressively to prove that they are right.

Brothers and sisters! If you watch the presentations by both Judge Brett Kavanaugh and Judge Clarence Thomas, you will notice that they were aggressive in their representations especially Judge Brett Kavanaugh. However, Judge Clarence aggressiveness was with a cool element but determined that he is right.

Blame on Third Party

Brothers and sisters! Judge Clarence Thomas did not refute the allegations by Professor Anita Hill but he attributed to a third party who wanted to destroy his career. As below is the extract from Question and Answer between the Chairman and Judge Clarence Thomas:

Judge: Senator! I believe that someone, some interested group, I don’t care who it is, in combination came up with the story and used this process to destroy me.

Chairman: Got Professor Hill to make up the story?

Judge: I believe that in combination the story was developed or concoctive to destroy me.

Chairman: with Professor Hill? This is critical question. Are you saying with Professor Hill group…….. (That Senator was interrupted)

Judge: That is just my view Senator. I … (Chairman did not let Judge complete the answer)

Chairman: I am trying to make….. (Again the Chairman was interrupted)

Judge: I am not (inaudible) no details to anything else. The story developed. I do not believe story is not true. The allegations are false and my view is other put together developed this (inaudible)

Chairman: And put in Professor Hill’s name?

Judge: I don’t know. I don’t know how it got there. All I know is that the story is here and it was concocted.

Chairman: Well Judge! I know you believe that and I am not here to (inaudible) or attempt to this moment refute that. There has been assertion made. I want to know if you want to agree with it that it is important to first keep our (inaudible), either Professor Hill has a story that she told someone, it was taken advantage of by being leaked, that is one thing. She says that and the other story is to be (inaudible) not by you (inaudible) your belief is that a group sat down and decided to make up the story and found (inaudible) vessel in Professor Hill, and got her to say it. Now there you are fundamentally different things ……(Chairman was interrupted)

Brothers and Sisters! Judge Brett Kavanaugh does not deny that Dr Christine Blasey Ford has not been sexually assaulted but it was not him. As below is the extract from Witness Statement of Judge Brett Kavanaugh:

Second, let’s turn to specifics.

I categorically and unequivocally deny the allegation against me by Dr. Ford.

I never had any sexual or physical encounter of any kind with Dr. Ford.

I’ve never sexually assaulted Dr. Ford or anyone.

Again, I am not questioning that Dr. Ford may have been sexually assaulted by some person in some place at some time. But I have never done that to her or to anyone.

Categorical Denial

I would like to start by saying unequivocally, un categorically that I deny each and every single allegation against me today that suggested anyone that I had conversation of a sexual nature or about pornographic material with Anita Hill that I even attempted to date her that I ever had any personal sexual interest in her or that I in any way ever harassed her.

And from my standpoint, as a black American, as far as I’m concerned it is a high-tech lynching for uppity blacks who in any way deign to think for themselves, to do for themselves, to have different ideas, and it is a message that unless you kowtow to an old order, this is what will happen to you. You will be lynched, destroyed, caricatured by a committee of the U.S. Senate rather than hung from a tree.

This confirmation process has become a national disgrace. The Constitution gives the Senate an important role in the confirmation process, but you have replaced advice and consent with search and destroy.

Since my nomination in July, there’s been frenzy on the left to come up with something, anything to block my confirmation. Shortly after I was nominated, the Democratic Senate leader said he would, quote, “oppose me with everything he’s got.” A Democratic senator on this committee publicly — publicly referred to me as evil — evil. Think about that word. It’s said that those who supported me were, quote, “complicit in evil.” Another Democratic senator on this committee said, quote, “Judge Kavanaugh is your worst nightmare.” A former head of the Democratic National Committee said, quote, “Judge Kavanaugh will threaten the lives of millions of Americans for decades to come.”

I understand the passions of the moment, but I would say to those senators, your words have meaning. Millions of Americans listen carefully to you. Given comments like those, is it any surprise that people have been willing to do anything to make any physical threat against my family, to send any violent e-mail to my wife, to make any kind of allegation against me and against my friends. To blow me up and take me down.

You sowed the wind for decades to come. I fear that the whole country will reap the whirlwind.

The behaviour of several of the Democratic members of this committee at my hearing a few weeks ago was an embarrassment. But at least it was just a good old-fashioned attempt at Borking.

Those efforts didn’t work. When I did at least OK enough at the hearings that it looked like I might actually get confirmed, a new tactic was needed.

Some of you were lying in wait and had it ready. This first allegation was held in secret for weeks by a Democratic member of this committee, and by staff. It would be needed only if you couldn’t take me out on the merits.

When it was needed, this allegation was unleashed and publicly deployed over Dr. Ford’s wishes. And then — and then as no doubt was expected — if not planned — came a long series of false last-minute smears designed to scare me and drive me out of the process before any hearing occurred.

Crazy stuff. Gangs, illegitimate children, fights on boats in Rhode Island. All nonsense, reported breathlessly and often uncritically by the media.

This has destroyed my family and my good name. A good name built up through decades of very hard work and public service at the highest levels of the American government.

This whole two-week effort has been a calculated and orchestrated political hit, fuelled with apparent pent-up anger about President Trump and the 2016 election. Fear that has been unfairly stoked about my judicial record. Revenge on behalf of the Clintons and millions of dollars in money from outside left-wing opposition groups.

This is a circus. The consequences will extend long past my nomination. The consequences will be with us for decades. This grotesque and coordinated character assassination will dissuade competent and good people of all political persuasions, from serving our country.

Similarity With Senator Al Franken

Brothers and Sisters! It also appears that Judge Brett Kavanaugh has followed the allegations made against Senator Al Franken who resigned from his post. In this case the similarity is as below:

CONCLUSION

In short, the above analysis clearly depict that Judge Brett Kavanaugh has followed the precedent set by Judge Clarence Thomas to get away from the allegations made by Dr Christine Blasey Ford likewise Judge Clarence Thomas got away of the allegation of Sexual harassment against him by Professor Anita Hill:
